要点

本規約は、メモアプリ「めも庭」(memoniwa.app・以下「本アプリ」)の利用条件を定めるものです。本アプリを利用した時点で、本規約に同意したものとみなします。

1. 適用範囲

本規約は、本アプリおよび本アプリに付随する機能(共有カード・みんなの庭・招待リンクの案内ページ等)の利用に適用されます。利用者情報の取り扱いについては、プライバシーポリシーが本規約の一部を構成します。

2. 利用資格

本アプリはアカウント登録を必要とせず、どなたでも利用できます。未成年の方は、保護者の同意を得たうえで利用してください。保護者の方は、お子さまが「みんなの庭」を利用する場合、招待リンクの送り先や書き込む内容についてご配慮ください。

3. データの保存と利用者の責任

本アプリのメモ・写真・設定は、利用者の端末内にのみ保存されます。端末の故障・紛失・アプリの削除・OSの初期化等によるデータの消失について、運営者は復元の手段を持ちません。大切な内容は、アプリの「バックアップ」機能で控えを取ってください。

4. 共有機能について

共有カード — メモンをリンクまたはQRコードで送る機能です。リンクを知る人は誰でも内容を開けます。送り先の選択は利用者の責任で行ってください。リンクは作成時に選んだ期限(24時間・7日・30日)で必ず失効します。

みんなの庭 — 複数人が同じ庭を見て書き込む機能です。庭を作った人を「共有者」、招待リンクから参加した人を「参加者」と呼びます。

5. 禁止事項

本アプリの利用にあたり、次の行為を禁止します。とくに、他の人が読む場所(みんなの庭・共有カード・参加者の名前を含みます)へ次の内容を書き込むことを認めません。

  1. 法令または公序良俗に反する行為
  2. 他の利用者・第三者に対する、いやがらせ・いじめ・脅迫・つきまとい
  3. 差別的な表現、他人を傷つける中傷、名誉を毀損する内容
  4. わいせつな内容、暴力的・残虐な内容、その他他人が不快に感じる内容
  5. 他人になりすます行為
  6. 本人の同意なく、他人の個人情報・写真・連絡先を掲載する行為
  7. 児童の権利を害する内容の掲載
  8. 他人の著作権・商標権その他の権利を侵害する内容の掲載
  9. 営利目的の宣伝・勧誘・スパムの送信
  10. 本アプリのサーバーに過度の負荷をかける行為、不正にアクセスする行為、本アプリを改変・逆コンパイルして制限を回避する行為
  11. その他、運営者が不適切と判断する行為

みんなの庭では、あらかじめ定めた語と共有者が追加した語を、書き込み時に自動的に伏せ字へ変換します。これは補助的な仕組みであり、すべての不適切な表現を検出できるものではありません。

6. 通報と対応

運営者は、不適切な内容および他の利用者へのいやがらせに対して寛容な姿勢を取りません。

7. 知的財産

利用者が本アプリに書いた内容(メモ・リスト・名前・写真)の権利は、利用者に帰属します。運営者がこれらの権利を取得することはなく、内容を閲覧・利用することもありません。

本アプリのイラスト・デザイン・プログラム・「めも庭」「メモン」の名称に関する権利は、運営者に帰属します。

8. アプリ内購入

本アプリのアプリ内購入は、App Store および Google Play を通じて行われます。決済・返金・購入の復元は各ストアの規定に従います。購入した内容は、同じ App Store / Google Play アカウントで復元できます。

購入したアイテムは本アプリ内でのみ利用できるものであり、換金・譲渡はできません。

9. 広告

本アプリは、利用者が自分で選んだ場合の動画広告と、みんなの庭を新しく作ったときの全画面広告を表示します。メモを書く・読む・探す画面に広告は表示されません。アプリ内購入の「広告を表示しない」により、いずれの広告も表示されなくなります。詳細はプライバシーポリシーをご覧ください。

10. サービスの変更・停止

運営者は、本アプリの内容を変更し、または提供を停止することがあります。共有機能に関わるサーバーの提供を終了する場合は、可能な範囲で事前に本サイトおよびアプリ内でお知らせします。端末内のメモは、サーバーの提供状況にかかわらず利用できます。

11. 免責

本アプリは現状有姿で提供され、特定の目的への適合性・不具合がないことを保証するものではありません。運営者は、本アプリの利用により利用者に生じた損害について、運営者の故意または重過失による場合を除き、責任を負いません。

みんなの庭における利用者間のやり取り・トラブルについては、当事者間で解決していただきます。運営者は、必要に応じて第6条の措置を取ります。

消費者契約法その他の強行法規により運営者の責任の全部を免れることができない場合、運営者はその法令の定める範囲で責任を負います。

12. 本規約の変更

本規約を変更する場合は、本ページで新しい内容と改定日を告知します。利用者に重大な影響のある変更は、アプリ内でも告知します。

13. 準拠法・管轄

本規約は日本法に準拠します。本アプリに関して紛争が生じた場合は、運営者の所在地を管轄する地方裁判所を第一審の専属的合意管轄裁判所とします。

In short

  • What you write is yours. We never acquire any rights to it.
  • In a shared garden, where other people read what you write, harassment and inappropriate content are not allowed. We delete what is reported, and we refuse service to people who keep doing it.
  • What you share is encrypted on your device, so we cannot read it to check it. The person who made a garden is the one who manages what is in it.

These Terms set out the conditions for using the memo app “Memolet Garden” (memoniwa.app, “the App”). By using the App you are taken to have agreed to these Terms.

1. Scope

These Terms apply to the App and to the features around it — shared cards, shared gardens, the pages that receive invite links, and so on. The Privacy Policy forms part of these Terms and governs how information about users is handled.

2. Who can use the App

The App needs no account and anyone may use it. If you are a minor, please use it with the consent of a parent or guardian. Guardians: if your child uses a shared garden, please pay attention to who the invite link is sent to and what is written there.

3. Your data and your responsibility

Memos, photos, and settings in the App are stored only on your device. We have no way to recover data lost through a broken or lost device, deleting the App, resetting the OS, or anything similar. Please keep a copy of anything important using the App’s Backup feature.

4. Sharing features

Shared cards — send a Memolet as a link or a QR code. Anyone who has the link can open it, so it is your responsibility to choose who you send it to. A link always expires after the period you chose when you made it: 24 hours, 7 days, or 30 days.

Shared gardens — several people see and write in the same garden. We call the person who made the garden the owner, and the people who joined from an invite link participants.

  • Managing the invite link — anyone who has the invite link can join that garden (and the passphrase too, for a garden that has one). Managing where the link goes is the owner’s responsibility.
  • The owner’s powers and responsibility — the owner can delete Memolets that participants placed, close the garden to new answers, and end the sharing. Keeping what is in the garden appropriate is the owner’s responsibility.
  • Participants’ names — the name you enter when you join is shown to the other people in that garden. It does not have to be your real name.
  • Expiry — a shared garden expires automatically on the day the owner picked when making it (45 days by default, at most 45 days ahead) and is deleted from the server. Viewing or writing does not extend it. The owner can change that day from the App (later than now, at most 45 days ahead; it can also be brought forward). It cannot be made permanent.
  • Outfits — an outfit worn by a Memolet in a shared garden is shown to other participants as an appearance only. It does not give them ownership of that outfit.

5. What is not allowed

The following are prohibited when using the App. In particular, they are not allowed anywhere other people read — shared gardens, shared cards, and participants’ names included.

  1. Anything against the law or against public order and morals
  2. Harassment, bullying, threats, or stalking of other users or third parties
  3. Discriminatory expression, abuse that hurts others, or defamatory content
  4. Obscene content, violent or cruel content, or anything else others would find offensive
  5. Impersonating someone else
  6. Posting another person’s personal information, photos, or contact details without their consent
  7. Posting content that harms the rights of children
  8. Posting content that infringes copyright, trademarks, or other rights of others
  9. Commercial advertising, solicitation, or sending spam
  10. Placing excessive load on the App’s servers, accessing them improperly, or modifying or decompiling the App to get around its limits
  11. Anything else we judge to be inappropriate

In a shared garden, a predefined list of words plus any words the owner adds are automatically masked as they are written. This is an aid, not a guarantee: it cannot catch every inappropriate expression.

6. Reports and what we do about them

We are not tolerant of inappropriate content or of harassment of other users.

  • How to report — use “Report” on the shared garden screen, or write to [email protected]. Please tell us which garden, which Memolet, and what the problem was.
  • What we do — we check reports promptly, and where we find a breach of these Terms we take the steps needed: suspending that sharing, deleting the data concerned, or refusing further use of the App.
  • What the owner can do — individual posts inside a garden can be deleted by that garden’s owner. Participants can leave the garden.
  • The limits of what we can do — the contents of a shared garden are encrypted on the device, and we cannot read them on the server. What we do is therefore based on the report itself and on what the reporter gives us, such as screenshots. Suspending or deleting a garden is something we can do without reading it.

7. Intellectual property

The rights in what you write in the App — memos, lists, names, photos — belong to you. We do not acquire those rights, and we do not view or use what you write.

The rights in the App’s illustrations, design, and program, and in the names “めも庭 / Memolet Garden” and “メモン / Memolet”, belong to us.

8. In-app purchases

In-app purchases are made through the App Store and Google Play. Payment, refunds, and restoring purchases follow each store’s rules. What you have bought can be restored with the same App Store or Google Play account.

Items you buy can only be used inside the App. They cannot be exchanged for money or transferred.

9. Advertising

The App shows video ads that you choose to watch, and a full-screen ad when you make a new shared garden. No ads appear on the screens where you write, read, or search your memos. The in-app purchase “Remove ads” turns off both kinds. See the Privacy Policy for details.

10. Changes to and suspension of the service

We may change what the App does, or stop providing it. If we end the server side of the sharing features, we will give notice on this site and in the App as far as we reasonably can beforehand. The memos on your device work regardless of whether the servers are running.

11. Disclaimer

The App is provided as is. We do not warrant that it fits any particular purpose or that it is free of defects. Except in cases of our intent or gross negligence, we are not liable for damage arising from your use of the App.

Disputes between users in a shared garden are to be resolved between the parties involved. We take the steps in Article 6 where necessary.

Where mandatory law — Japan’s Consumer Contract Act or otherwise — does not allow us to exclude liability entirely, we are liable to the extent that law provides.

12. Changes to these Terms

If we change these Terms, we will post the new text and the revision date on this page. Changes that materially affect users will also be announced in the App.

13. Governing law and jurisdiction

These Terms are governed by the law of Japan. If a dispute arises regarding the App, the district court with jurisdiction over our location shall be the exclusive court of first instance by agreement.

Where the mandatory consumer law of your country of residence gives you rights that this article cannot take away, that law applies to that extent.
